Overview

This website, fancyfroggy.com, is operated by Fancy Froggy LLC ("Fancy Froggy," "we," "us," or "our"). By visiting our site, buying from us, or buying our products through another platform (such as the Shop app, Meta, or an AI shopping assistant), you agree to these Terms of Service, along with our Privacy Policy, Refund Policy, Shipping Policy, and Cancellation Policy, which are part of these Terms.

Who can buy

You must be at least the age of majority where you live, or have permission from a parent or guardian, to place an order. You agree to give us accurate, current information when you order, including your email and shipping address.

Our products

Fancy Froggy products are original artwork. Desk Friends and other polymer clay pieces are sculpted and painted by hand, so each one is unique. Small differences in color, shape, and detail from the product photos are part of the handmade process and are not defects. Colors may also look different depending on your screen.

Desk Friends and other sculptures are decorative art, not toys. They contain small parts and are not suitable for young children.

Some products, including our apparel and phone cases, are printed to order by our production partner and shipped directly from their facility.

Orders and pricing

All prices are in U.S. dollars unless shown otherwise. We may change prices, products, or availability at any time. We reserve the right to refuse or cancel any order, including orders with pricing or listing errors, orders that appear fraudulent, or orders we can't fulfill. If we cancel an order after you've been charged, we'll refund you in full.

Snail Mail Club subscriptions

The Snail Mail Club is a monthly subscription that renews and charges automatically until you cancel. Signups for each month's mail close on the last day of the month before, so signing up any day in a given month starts your subscription with the next month's mail. Shipping, returns, and refunds

Shipping is covered by our Shipping Policy, and returns, refunds, and damaged items are covered by our Refund Policy.

Intellectual property

All artwork, characters (including Fancy, Ollie, Jenny Sparkles, Tex, and the Snail Mail Club snails), stories, designs, photos, logos, and other content on this site and on our products belong to Fancy Froggy LLC. Buying a product gives you ownership of that physical item for personal use. It does not give you any right to copy, reproduce, resell reproductions of, or make commercial use of our artwork, characters, or designs.

Reviews and submissions

If you send us or post reviews, photos, comments, or ideas, you give us permission to use, display, and share them in connection with Fancy Froggy, including on our website and social media. You agree not to submit anything unlawful, abusive, or that infringes someone else's rights.

Third-party services

Our store runs on Shopify. Payments, subscriptions, printing, shipping, and purchases made through other platforms are handled by third-party providers. Their own terms and privacy policies apply to your use of their services. We aren't responsible for third-party services we don't control.

Disclaimer

Our site and products are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability and fitness for a particular purpose.

Limitation of liability

To the fullest extent allowed by law, Fancy Froggy LLC will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our site or products. Our total liability for any claim will not exceed the amount you paid for the product involved.

Indemnification

You agree to hold Fancy Froggy LLC harmless from claims arising out of your violation of these Terms or misuse of our site or products.

Governing law

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Indiana.

Changes

We may update these Terms from time to time. Changes take effect when posted on this page. Your continued use of the site after changes means you accept them.
